Dear Employee,

"This offer represents two (2) weeks' pay per year of service"

There is no weeks-per-year rule. Courts set severance by your age, your role, and your length of service. For most people it's measured in months.

"Payment has been calculated based on your base salary"

Your bonus, commissions, benefits, and pension count too. An offer built on salary alone is almost always too low.

"This offer is made in accordance with the Employment Standards Act"

The minimum the law allows is the floor, not the real number. Most employees are owed the common law amount, which sits on top of it.

"This offer remains open until Friday at 5:00 p.m."

Their deadline, not yours. Your claim is good for two years. Deadlines like this exist to get a signature before you get advice.

"In exchange, you agree to release all claims against the company"

The only sentence in the letter you can't undo. Everything above it can still change. This one can't, once you sign.

Do federally regulated employees get less severance? No

This is one of the most common myths out there. Whether you work in banking, telecom, trucking, or another federally regulated job, your severance is figured the same way as everyone else's: your age, your role, and how long you worked there. The minimum on your statement might look small, but the real number sits well above it.

What counts as a federally regulated job

Some industries fall under federal rules instead of Ontario's:

Banks
Airlines and air transport
Trucking and interprovincial transport
Telecom and broadcasting

It changes which law applies, not the basic fact that if you're let go without proper compensation, you're owed.

“One day per year” is an offer, not the law

Two weeks plus a couple of days per year is the bare federal floor, not your real number. Like provincial employees, you're usually owed far more once your age, role, and years are factored in. Employers lean on the minimum because most people don't know there's more. There usually is.

Unjust dismissal: a protection provincial employees don't have

Federally regulated employees often have an extra protection called unjust dismissal, which can let you challenge a firing and, in some cases, even ask to get your job back, on top of severance. So a federal firing isn't always just about the cheque. It's worth knowing exactly what your options are.

An American company on Canadian soil

If you work in Canada, your severance rights are decided by Canadian law, not by where the company is headquartered. A foreign parent company doesn't lower what you're owed.
