You can't be fired for complaining

Punishing you for raising a harassment complaint is an illegal reprisal, even if the harassment is never proven. If they fire you, cut your hours, or sideline you after you spoke up, that's against the law, and it can be a human rights violation on top of your severance.

The employer has a duty to investigate and fix it

Your employer has a strict legal duty to investigate a harassment complaint and actually do something about it. Doing nothing, or running a sham investigation, is a breach. If they won't act, you may be able to leave and claim compensation instead of enduring it.

When the harasser is your boss

You still have options. You can report higher up and document everything, and if there's no one safe to tell or nothing gets done, the law treats the employer as having failed its duty. You don't have to keep working under the person harassing you with no way out.

You don't have to just quit

A workplace poisoned by harassment your employer won't fix can be a constructive dismissal, which means you can leave and still claim full severance. But how and when you leave matters. Walking out the wrong way can give away money you're owed, so get advice before you do anything.

Reprisal grows your claim, it doesn't shrink it

Being let go over a complaint usually means more than an ordinary severance: your regular amount based on age, role, and years, plus extra compensation for the reprisal and any human rights violation. And it's not just the target who's protected, a witness who backs up a coworker's complaint can't be fired for telling the truth either.

Sexual harassment and your safety
