Dear Employee,

"This offer represents two (2) weeks' pay per year of service"

There is no weeks-per-year rule. Courts set severance by your age, your role, and your length of service. For most people it's measured in months.

"Payment has been calculated based on your base salary"

Your bonus, commissions, benefits, and pension count too. An offer built on salary alone is almost always too low.

"This offer is made in accordance with the Employment Standards Act"

The minimum the law allows is the floor, not the real number. Most employees are owed the common law amount, which sits on top of it.

"This offer remains open until Friday at 5:00 p.m."

Their deadline, not yours. Your claim is good for two years. Deadlines like this exist to get a signature before you get advice.

"In exchange, you agree to release all claims against the company"

The only sentence in the letter you can't undo. Everything above it can still change. This one can't, once you sign.

Termination without cause in Ontario

Can your employer fire you for no reason?

Yes, and that's normal. In Ontario, an employer can let you go without giving a reason, as long as they pay you proper severance. “Without cause” just means it isn't your fault. It doesn't mean it's free for them. The trade-off for being able to let you go is the severance they owe you for doing it.

How much severance are you owed?

Almost always more than the offer. It's based on your age, your role, and how long you worked there, measured in months, not weeks. There's no week-per-year rule. Bonus, commission, benefits, and pension count too, not just base salary. Most first offers come in well below the real number.

Were you let go, even if no one said “fired”?

They can't avoid severance by quietly letting your shifts dry up and never saying the word. A sale of the business usually counts as a termination unless you keep working for the buyer on the same terms. And being part of a big layoff doesn't change anything: your severance is still individual, based on your age, job, and years, not on how many people went out the door with you.

Working notice instead of a payout

It counts, but it usually doesn't cover everything. Working notice gets credited toward the severance you're owed, but employers tend to give less notice than the law requires. If you're owed eight months and work six, that six counts, and you're still owed the other two. Worth checking the math before you assume it's squared away.

Before you sign

The deadline on the offer is theirs, not the law's, your rights don't expire when it passes, and you have two years to bring a claim. You can negotiate it yourself, but most people leave money on the table because the hard part is knowing the right number, and employers count on you not knowing it. Find out where you stand first.
