Workplace discrimination and human rights in Ontario

When is being let go actually discrimination?

The general rule is that an employer can let you go for almost any reason if they pay proper severance. The exception is a discriminatory one. If you were really let go because of your age, your health, a pregnancy, or another protected ground, paying severance doesn't make it legal, and you're owed damages on top.

How would you even know?

You rarely get it in writing, and you don't have to. Patterns tell the story: hints about retirement, being replaced by someone younger and cheaper, sudden “performance” issues after years of good reviews, or a termination that lands right after you disclosed a pregnancy or a health condition. The timing and the pattern often say more than the paperwork.

Human rights damages are on top of your severance

They're separate. Your severance compensates you for losing the job; human rights damages compensate you for the discrimination itself. You can get both. And if you're an older worker who'll take longer to find work, your severance itself may be enhanced too.

Some of the clearest protected situations

These are common red flags the Human Rights Code protects against:

Being pressured or hinted toward retirement (age discrimination)
Being fired or penalized after a WSIB claim or a work injury
Blanket or random drug testing outside a genuinely safety-sensitive job
Refusing to accommodate a real childcare or family obligation

What to do

Document the pattern: dates, names, and anything in writing. Sudden performance issues after a protected disclosure are a classic setup, so respond in writing to anything you disagree with, and get advice early. The review is free, and we work on contingency.
