Disability and medical leave at work in Ontario

They can't fire you for being sick or on leave

An employer can't let you go for being ill or off on a medical leave. If they do, it's a human rights violation, and that money sits on top of your severance. Your time on leave still counts toward your years there. A firing that lands right after a leave usually says more than the paperwork does.

The duty to accommodate is real, within reason

If a medical condition affects your work, your employer has to try to adjust, modified duties, modified hours, time off for treatment, working from home where it fits. “It's a bit inconvenient” is not a defence. They only get out of it if the change would be a genuine, serious hardship, and refusing to even try is where they get into trouble.

“Come back only when you're 100%” is not allowed

An employer can't demand you be fully recovered before they'll have you back. Their job is to accommodate what you can do now, a gradual return, lighter hours, modified duties, not to sideline you until you're perfect. A “100% or nothing” rule is itself a violation of your human rights.

Your diagnosis is private

Your employer can ask how long you'll be off and what you're able to do, but not what's wrong with you. Your diagnosis and treatment are yours. A doctor's note on your limits is enough. Endlessly demanding more proof to stall can itself be part of a failure to accommodate.

When the insurer and the employer squeeze you at once

An insurer cutting off your benefits doesn't let your employer declare you've abandoned your job. If you're genuinely still unwell, you're protected. Because a denied benefit and a shaky job often hit at the same time, it helps to handle them together rather than fighting on two fronts alone.

Ignored when you try to return?

If you're cleared to come back and your employer stalls, goes quiet, or has no job for you, being left in limbo can be a termination, with severance owed. You don't have to accept it quietly. The review is free, and we work on contingency.
