Volkswagen Layoffs: What Ontario Employees Are Owed in Severance
The deadline on a Volkswagen severance letter is set by the employer, not by law. Ontario's ESA floor is counted in weeks, and the common law usually adds months on top of it.

Key takeaways
- Check your years of service against the 5 year line.
- Check that your benefits keep running. If you are paid a lump sum instead of notice, the ESA still requires benefit plan contributions to continue for the statutory notice weeks.
- Check that the offer counts all your time with the employer. For ESA severance pay, every period of service counts, whether or not it was continuous.
- Check that severance pay is a separate line from notice pay. ESA severance pay is owed in addition to termination pay, so one combined number can hide a shortfall.
- Check the weekly rate if your pay varies. For commission or other variable pay, the ESA uses your average regular wages over the 12 weeks before termination, for both pay in lieu and severance pay.

⚡Quick answer. Volkswagen is cutting jobs across its group. In Ontario the ESA notice and severance rules set a floor, and common law notice usually runs to months above it.
What did Volkswagen announce?
| At a glance | What the public record shows |
|---|---|
| Announced | 3 September 2026, board approval of the cuts |
| Effective | Not disclosed |
| People affected | 100,000 job cuts across the group |
| Share of workforce | Not disclosed |
| Layoff or furlough | Job cuts, described by the board as an "adjustment of the employee numbers" |
| Canadian impact | Not disclosed; the group lists Volkswagen Group Canada among its subsidiaries |
What should you do in the first 48 hours?
- The deadline is your employer's, not the law's; ask in writing for more time.
- Sign nothing, including the release; do not resign or agree it was a resignation.
- Save what you can; ask HR in writing for your contract, plan documents and pay stubs.
- Write down the date, who told you and what was said.
- Apply for EI online after your last day, without the Record of Employment; over 4 weeks late can cost benefits.
👥If your colleagues got the same letter. Compare notes on what each of you was offered. Count how many people at your location got a letter in the same 4 weeks: 50 or more raises the ESA minimum notice. Do not sign as a group on the employer's timetable; each person can ask for time. Keep every letter.
Does Ontario law apply if your employer's parent company is outside Canada?
Yes. Section 3 of the Employment Standards Act, 2000 applies to you if your "work is to be performed in Ontario", wherever the parent company sits and whichever Volkswagen entity issues your pay stub or signed your offer letter.
What is the ESA minimum for a layoff this size?
- Notice or termination pay (s. 57). Once you have 3 months of service (s. 54), you get 1 week if you have worked under a year, 2 weeks from 1 to 3 years, then 1 week per completed year up to 8 weeks at 8 years.
- Group notice (s. 58). If 50 or more people at your location lose their jobs within 4 weeks, the minimum notice rises to between 8 and 16 weeks depending on how many; the count is per location, not global.
- Severance pay (s. 64). It is owed if you have 5 or more years and the employer's payroll is $2.5 million or more, which an employer this size very likely meets.
- How much (s. 65). Severance pay is 1 week of regular wages per year of service, with partial years counted in months, capped at 26 weeks.
The mass termination rules set out how the location count works and when it does not apply. These are only minimums; severance pay in Ontario explains how they sit beside what a court would award.
What are you actually owed at common law?
The first package is usually built on the ESA floor, and the common law usually sits well above it. How far above comes from the factors in Bardal v. Globe & Mail Ltd., 1960 CanLII 294 (ON SC): your age, your years of service, the kind of job you held and how easy similar work is to find in your field right now.
If part of your pay is RSUs, options or a bonus, severance for tech workers covers how equity is counted.
Estimate your own range
Enter your age, years of service, role and pay to see where your notice might fall. It is an estimate, not a promise.
What do tech severance packages usually get wrong?
- Equity. RSUs and options that would have vested during your notice period can be owed: Wigdor v. Facebook Canada Ltd., 2026 ONCA 572, a 2026 Court of Appeal decision, voided clauses ending vesting at termination for the ESA notice weeks.
- Bonus. A bonus earned during the notice period is usually owed, even if the plan requires active employment on the payout date (Paquette v. TeraGo Networks Inc., 2016 ONCA 618).
- Termination clause. If one sentence in the termination section breaks the ESA, often the for cause paragraph, the whole clause fails and you are back to common law notice (Waksdale v. Swegon North America Inc., 2020 ONCA 391).
The notice period is a runway: a new job inside it reduces what is owed for the remaining months without erasing the claim. EI is not deducted, and the ESA amounts are owed in full even if you start a new job.
What should you do before you sign?
The release is the one thing you cannot undo, because once you sign it the claim for anything more is usually gone, so have the numbers checked by someone who acts only for you, not for the employer. Mirza Law offers a free severance review of your letter, contract, bonus and equity, works on a percentage of what it recovers, and charges no fee if nothing is recovered.

How we can help
Frequently asked questions
What happens if the deadline passes and I have not signed?
Your ESA minimum is still owed, because the Act requires it whether or not you sign a release. The employer may withdraw the extra it offered on top, but you keep the right to claim common law notice.
Is a package above the ESA minimum enough?
Not necessarily. Many first offers add a few weeks to the ESA floor and stop well short of common law notice. Unless your contract validly limits you to the ESA, compare the offer in months against the court ranges for your profile.
What happens to RSUs that vest after my last day?
It turns on whether the vesting date falls inside the notice period you are owed. Grants that would have vested during that period can be claimed as damages, subject to your plan's wording; grants scheduled after it usually cannot. Get your grant agreement and vesting schedule before you sign.
Do my health benefits stop today?
Not under the ESA minimum. Your employer must keep up the contributions that maintain your benefits for your statutory notice weeks, whether you work them or are paid a lump sum instead (s. 60 and s. 61). If it stops early, the missed contributions are treated as unpaid wages you can claim (s. 60(3)).
