BMW Layoffs: What Ontario Employees Are Owed in Severance

If BMW hands you a severance letter, the employer picked the signing date, not the law. Ontario's ESA guarantees weeks of pay, and the common law usually adds months.

Key takeaways

  • Check that your service count includes leaves and any earlier stint with the employer.
  • Check that your severance pay counts the notice weeks you were paid out instead of working.
  • Check that your benefits continue through the ESA notice weeks. Sections 60 and 61 require the employer to keep making benefit plan contributions for that period, even if you are paid out in a lump sum.
  • Check the vesting date and value of every RSU and option grant. List each tranche that falls inside your likely notice period, with its value on that date, before you weigh the offer.
  • Check your Record of Employment for the right last day and reason. A wrong date or code can delay your EI, so ask the employer in writing to correct it.

✅Quick answer. BMW's Chinese joint venture has reportedly begun layoffs, and none are confirmed in Canada. If your Ontario job is cut, you are owed ESA notice or termination pay, severance pay at 5 or more years if the payroll test is met, and often months more at common law unless a valid clause caps you at the minimum.

What should you do in the first 48 hours?

  • The deadline is your employer's choice, not the law's; ask in writing for more time.
  • Sign nothing, including the release; do not resign or call it one.
  • Save what you can; ask HR in writing for your contract, plan documents, pay stubs.
  • Note the date, who told you, what was said.
  • Apply for EI after your last day without waiting for the Record of Employment; apply within 4 weeks or you can lose benefits.

Hi [Manager name],

Thank you for meeting with me on [date] and for explaining the package. I want to review it carefully and get advice before I respond. Could you please extend the deadline by two weeks so I have time to do that? I would be grateful if you could confirm the new date in writing.

Thank you,

👥If your colleagues got the same letter. Compare notes on what each person was offered. Count how many people at your location got a letter in the same 4 weeks, because 50 or more changes the ESA minimum. Do not sign together on the employer's timetable; each of you can ask for more time. Keep every letter.

Does Ontario law apply if the parent company is abroad?

Yes: ESA s. 3(1) applies the Act when your work is performed in Ontario. The ESA sets your minimum, and the common law sets what you are actually owed above it; severance pay in Ontario explains how the two fit together.

What is the ESA minimum?

Under s. 57, notice depends on your years of service: 1 week under a year, 2 weeks from 1 to 3 years, then 1 week per completed year up to 8 weeks at 8 years.

Under s. 58, if 50 or more people at your location lose their jobs within 4 weeks, the minimum notice rises to between 8 and 16 weeks depending on how many, and the count is per location, so cuts abroad do not add to it. The mass termination rules set out the tiers.

Under s. 64, severance pay is owed if you have 5 or more years of service and either the employer's payroll is $2.5 million or more or 50 or more people lose their jobs within 6 months because part of the business permanently closes.

If you are paid out instead of working your notice, s. 61 requires a lump sum equal to the wages you would have earned during it.

Under s. 65, severance pay is 1 week of regular wages per year of service, counting partial years in months, capped at 26 weeks. It is paid on top of your notice or termination pay.

What are you actually owed at common law?

How far above the ESA floor you land depends on the factors in Bardal v. Globe & Mail Ltd., 1960 CanLII 294 (ON SC): age, years of service, the kind of job and how hard similar work is to find.

What do tech severance packages usually get wrong?

  • They cancel unvested RSUs and options on your last day, but O'Reilly v. IMAX Corporation, 2019 ONCA 991, held "cancelled immediately" wording was not enough, and Wigdor v. Facebook Canada Ltd., 2026 ONCA 572, a 2026 Court of Appeal decision, awarded RSUs vesting in the notice period.
  • They drop your bonus for the notice period, but Paquette v. TeraGo Networks Inc., 2016 ONCA 618, held that an active employment requirement alone does not take it away.
  • They rely on a termination clause, but if one sentence in the termination section breaks the ESA, often the for cause paragraph, the whole clause fails and you are back to common law notice (Waksdale v. Swegon North America Inc., 2020 ONCA 391).

What should you do before you sign?

The release is the one thing you cannot undo, so get the numbers checked before you sign it. A free severance review puts your ESA floor and common law range side by side; the firm works on a percentage of what it recovers, and there is no fee if nothing is recovered.

Frequently asked questions

What happens if the deadline passes and I have not signed?

Your ESA minimum is still owed, because the Act requires it to be paid whether or not you sign anything. The employer can withdraw the extra it offered above the ESA, but your common law claim does not end on the employer's chosen date.

Is a package above the ESA minimum enough?

Not necessarily. The ESA is a floor counted in weeks, while common law notice for the same person is often counted in months. Compare the offer with the court ranges for your profile and with the termination clause in your contract.

What happens to RSUs that vest after my last day?

What usually matters is whether the grant would have vested during your notice period, not whether it vests after your last day of work. Ask for the vesting schedule in writing and check whether the offer pays anything for those tranches.

Does a layoff with a recall date mean I have been terminated?

It can: if your contract does not give the employer the right to lay you off, a layoff can be a dismissal at common law from the first day. Under ESA s. 56, a layoff longer than 13 weeks in any 20 consecutive weeks generally becomes a termination.
