They built a paper trail and called it performance. Failing a PIP isn't cause. Mirza Law gets back what you're owed, so a setup doesn't cost you your severance.

"A performance plan can be a real attempt to help, or the groundwork to push you out. Either way, failing one isn't cause, and they still owe you severance if they let you go."

Performance reviews and PIPs in Ontario, explained

A failed performance plan is almost never cause

Cause is meant for serious misconduct, not for falling short of targets. If you were genuinely trying and just couldn't hit the goals, that's a fit problem, not misconduct, and they still owe you full severance if they let you go. Failing a PIP doesn't erase what you're owed.

A sudden bad review after years of good ones

A negative review out of nowhere, after a strong track record, rarely reflects reality. More often it reflects a decision that's already been made, and the review is the start of the paper trail. Push back in writing, and get advice early, before that trail gets thicker.

A secret PIP isn't a real one

To mean anything, a performance plan has to be something you were told about, could actually read, and had a fair chance to meet. If you didn't know it existed, it can't be used to deny you severance later.

“Improve or it's cause” is usually a bluff

Letting someone go for cause over performance is extremely hard to do, especially for someone facing a slow market or factors outside their control. “Hit these numbers or it's cause” is a pressure line far more often than a real legal position.

Put your side on record

Respond in writing to anything in a review or a plan you disagree with, so your version is on file and silence isn't read as agreement. A plan can be a genuine attempt to help or a setup to push you out, and the difference matters later. Either way, being on one doesn't strip your rights.

What you're owed, and the hidden reason

If they let you go after a PIP, you're owed your full severance based on your age, role, and years, often many times the first offer. And if the plan appeared right after you disclosed a health condition or a pregnancy, or your age became a factor, the “performance” story may be a cover for discrimination, which adds human rights damages on top. The review is free, and we work on contingency.
