Overtime pay in Ontario, explained

Salary doesn't cancel overtime

Being on salary doesn't take away overtime. In Ontario, most employees, salaried or hourly, are owed time and a half for hours worked over 44 in a week. There are some narrow exemptions, but “you're salaried” on its own isn't one of them.

You can't contract out of it

If you worked the hours that qualify for overtime, a clause saying you waive it doesn't hold up. You can't sign away your legal entitlements, and the signature doesn't erase the law.

Unapproved overtime can still be owed

If the work genuinely needed doing and you actually did it, your employer usually has to pay for it, even without a sign-off in advance. “We didn't approve it” isn't a clean way out, especially when they knew you were doing the work.

How it's calculated

For most provincially regulated employees, overtime is time and a half for hours over 44 in a week, not over 8 in a day. It applies to salaried and hourly workers alike. A single long day may not trigger it, but a consistently long week does.

Proving your hours without a timesheet

A missing timekeeping system is the employer's problem, not a reason you can't recover. You have more to work with than you think:

Emails and their timestamps
Calendar entries and meeting invites
Building swipe or access records
Shift messages and your own notes made at the time

How far back, and the reprisal trap

You can usually claim unpaid overtime going back about two years, and if you're being let go, your severance should account for the overtime you'd have earned during the notice period. Firing you for asking about overtime, vacation, or holiday pay is an illegal reprisal. The review is free, and we work on contingency.
