The Ministry of Labour vs. your real severance

Can't you just call the Ministry to get your severance?

For severance, usually not. The Ministry only enforces the minimum under the Employment Standards Act, which is often a small fraction of what you're actually owed. Your real entitlement, the common-law amount, can be many times higher, and the Ministry can't get it for you.

Filing a complaint can cost you the court claim

For a termination, filing an ESA complaint can mean giving up your right to sue for the full amount in court. People file thinking they're being careful and end up capped at the minimum. The official-looking route is often the most expensive one.

Already filed? You may have a short window

There's generally a short window, often about two weeks, to withdraw a Ministry complaint and keep your right to pursue the full amount. If you've recently filed, it's worth getting advice right away, before that window closes.

When the Ministry is the right door

It's not the wrong place for everything. These are usually fine to take there:

Overtime
Vacation pay
Unpaid wages and similar ESA basics

It's termination and severance where the Ministry route tends to hurt you. The Ministry for the basics, a lawyer for what you're owed when you lose your job.

“The Ministry would say we owe nothing”

Employers lean on this because the ESA minimum is so much lower than the real number. “The Ministry would back us” usually just means “the Ministry only looks at the floor.” What you're owed at common law is a separate, much bigger question.

Who to talk to about your full number

Before you sign or file anything, talk to an employment lawyer who can tell you the real figure, often many times the minimum, and the right way to pursue it.
