Maternity and parental leave rights in Ontario

Can they fire you for being pregnant or on leave?

No. It's illegal to fire, demote, or penalize you because you're pregnant, announced a pregnancy, or are taking or returning from leave. That's a violation of the Human Rights Code. If a termination lands anywhere near your leave, the timing alone is a serious red flag.

“There's no job to come back to”

Almost never holds up. You have a right to return to the same job, at the same pay, on the same terms. “We restructured” or “the role's gone” is exactly what employers say to dress up an illegal firing. In nearly every case, being let go around your leave is a problem for them, not you.

Coming back to less than you left

Coming back to a worse version of your job, fewer hours, less pay, a lesser role, isn't the return you're entitled to. An employer can't impose that unilaterally. It can be a constructive dismissal, which means you can leave and claim full severance, plus human rights damages.

Laid off on or after your leave

You'd get your regular severance based on your age, role, and years, and if your leave had anything to do with it, human rights damages on top. Your time on leave doesn't reset the clock either, the months you were off still count toward your length of service, which is one of the things your severance is based on.

If it feels like they're building a case

Sudden “performance” issues after a pregnancy announcement are a classic setup. Take it seriously and start documenting: respond in writing to anything you disagree with, so silence isn't read as agreement. If they do let you go, that paper trail and the timing can make it a strong human rights case. The review is free.
