BMW Layoffs: What Ontario Employees Are Owed in Severance

The date on your BMW severance letter was picked by your employer, not set by any law. The ESA floor is counted in weeks; the common law usually adds months on top.

Key takeaways

  • Check whether service with a predecessor or related company counts toward your years. If you came over in an acquisition or moved between related companies, ask HR in writing which start date the offer uses, because your years set your ESA weeks and your common law notice.
  • Check that your ESA severance pay counts your notice weeks. If you are paid a lump sum instead of notice, s. 65(4) calculates your severance pay as if you had kept working through the notice weeks you were not given.
  • Check the vesting date on every RSU and option grant. List each tranche that falls inside your likely notice period, with its value on that date, before you weigh the offer.
  • Check that leaves are counted in your service. ESA severance pay counts all time with the employer, whether or not continuous and whether or not active (s. 65), so parental and sick leave count.
  • Check that your Record of Employment shows shortage of work (code A) and the right last day. A wrong code or date delays your EI, so ask the employer in writing to correct it.

✅Quick answer. BMW announced job cuts, none confirmed in Canada. If your Ontario job is cut, you are owed Employment Standards Act, 2000 (ESA) notice or termination pay, severance pay at 5 or more years if the $2.5 million payroll test is met, and often far more at common law unless a valid contract clause caps you at the minimum.

What should you do in the first 48 hours?

  • Ask for more time in writing.
  • Sign nothing, including the release, and do not resign or agree that you resigned.
  • Email HR for your contract, bonus plan and equity grant agreements; save your broker and pay portal records.
  • Write down the date, who told you and what was said.
  • Apply for EI online once your last day has passed, without waiting for the Record of Employment; applying more than 4 weeks after that day can cost you benefits.

Hi [Manager name],

Thank you for speaking with me on [date]. I have received the termination letter and package and would like to review it carefully before I respond.

Could you please extend the response deadline by two weeks so that I can have the package reviewed? Please confirm the new date in writing.

Thank you for your help with this.

👥If your colleagues got the same letter. Compare notes on what each of you was offered. Count how many people at your location got a letter in the same 4 weeks, because 50 or more changes the ESA minimum. Do not sign together on the employer's timetable; each of you can ask for more time. Keep the letters.

Does Ontario law apply if your employer is based outside Canada?

Yes, if you work in Ontario. Under ESA s. 3(1), the ESA covers you when your work is done in Ontario, wherever the parent company sits and whichever entity pays you, whether that is a Canadian subsidiary or a related company abroad.

What is the ESA minimum you are owed?

  • Notice (s. 57). After 3 months of service, you get 1 week of notice under 1 year, 2 weeks from 1 to 3 years, then 1 week per completed year up to 8 weeks at 8 years. The employer can pay a lump sum instead (s. 61).
  • Mass termination (s. 58 and O. Reg. 288/01, s. 3). If 50 or more people at your location are terminated within 4 weeks, the minimum rises to between 8 and 16 weeks under the mass termination rules.
  • Severance pay (s. 64). With 5 or more years, you are also owed severance pay if the employer's payroll is $2.5 million or more. A large employer almost always meets that payroll test.
  • Amount (s. 65). Severance pay is 1 week of "regular wages for a regular work week" per year of service, with partial years counted by the month, capped at 26 weeks.

What are you actually owed at common law?

Most first packages are built on the ESA floor, and the common law usually sits well above it, measured on your total pay rather than base salary alone. How far above comes from the factors in Bardal v. Globe & Mail Ltd., 1960 CanLII 294 (ON SC): your age, your years of service, the character of your role and how available similar jobs are. Our guide to severance pay in Ontario shows how they combine.

What do tech severance packages usually get wrong?

  • Unvested RSUs and options: Wigdor v. Facebook Canada Ltd., 2026 ONCA 572, a recent Court of Appeal decision, refused to enforce a clause that ended vesting on termination because s. 60 bars changes during the ESA notice period. O'Reilly v. IMAX Corporation, 2019 ONCA 991 also awarded damages for equity that would have vested during the notice period.
  • Bonus: under Paquette v. TeraGo Networks Inc., 2016 ONCA 618, an "active employment" clause alone does not cancel a bonus earned in the notice period.
  • Termination clause: if one sentence in the termination section breaks the ESA, often the for cause paragraph, the whole clause fails and you are back to common law notice (Waksdale v. Swegon North America Inc., 2020 ONCA 391).

What should you do before you sign?

The release is the one thing you cannot undo, so get the numbers checked against your contract and equity plans before you sign it. Mirza Law offers a free severance review and works on a percentage of what it recovers, with no fee if nothing is recovered.

Frequently asked questions

What happens if the date on the letter passes and I have not signed?

The employer may withdraw the part of the offer that sits above the ESA minimum. Your ESA notice and severance pay are still owed, and because you signed nothing, your common law claim stays open.

Does a lump sum delay my EI payments?

It can delay when they start, because Service Canada allocates severance and pay in lieu of notice over a period during which you generally cannot also collect EI. It usually changes the timing rather than the total, so it is no reason to put off applying.

How do I get my personal files off a work laptop I am locked out of?

Email HR a short list of the personal files you need, such as photos or tax documents, and ask them to send copies or set a time for you to collect them. Do not try to get around the lock or send company data to your own accounts. Keep a copy of the request with your notes.

What happens to my health benefits after my last day?

Under s. 60 and s. 61, your employer must keep your benefit plan contributions going through your ESA notice weeks, whether you work them or are paid a lump sum; after that, coverage usually stops unless your package extends it. At common law, unless a valid termination clause limits you to the ESA minimum, the value of your benefits for the full notice period is part of what you can claim. Ask HR in writing for the date each plan ends.
